Explaining the Differences Between Conventional and Same-Sex Divorce
Though the majority of same-sex divorce issues are not unique, there are many areas where they differ, such as in federal tax consequences, and the ability to get divorced in a state that does not recognize same-sex marriages.
- Federal tax consequences: Because of the Defense of Marriage Act (DOMA), same-sex marriage is not recognized by the federal government. This means that same-sex couples face unique tax problems when dividing retirement accounts and other similar assets in divorce. Additionally, same-sex partners cannot get tax breaks for transfers of property between spouses or a tax deduction for alimony.
- Divorce in other states: If you married in Massachusetts but now live in a state that prohibits same sex marriage, that state may not recognize the marriage and may not allow the divorce to proceed.
